Balearic Islands cracks down on illegal holiday lets with daily fines of up to €5,000
Owners who keep renting without a licence after being warned now face escalating penalties and possible prosecution for disobedience
If you own or rent an unlicensed holiday property in the Balearic Islands, the authorities are running out of patience. The regional government has announced a significant toughening of its approach to illegal tourist accommodation, introducing daily fines of between €500 and €5,000 for owners who continue to advertise and rent out properties without a licence after being formally warned by inspection services.That last part matters. Until now, a loophole in the system allowed owners to keep profiting from illegal lets while the formal sanctioning process ground slowly through the courts. The new daily fines are designed specifically to close that gap, hitting offenders in the pocket from the moment they ignore an official warning rather than months later when a case is finally resolved. For the legal operators who have jumped through every hoop to get licensed, and who compete daily against unlicensed rivals charging lower prices, it is a long overdue change.
If the violation continues even after the fines begin, cases can be referred directly to the Public Prosecutor's Office for a possible crime of disobedience. This is a meaningful escalation, treating repeat offenders as a criminal matter rather than simply an administrative one.
The measures were unveiled at the second meeting of the Committee for Combating Unfair Competition, alongside two further steps. Legal tourist establishments have been given new powers to request immediate assistance from the Security Forces to carry out evictions when illegal occupations occur or when facilities are being exploited for unauthorised residential use.
And in Ibiza, a new operational protocol has been agreed between local police forces and tourist inspection services, developed with the Consell Insular de Ibiza. The practical effect is straightforward: when police respond to any incident or neighbourhood complaint, they can now also trigger a tourist inspection file at the same time. Local police become a frontline detection tool for illegal accommodation rather than simply a public order resource.
The crackdown extends to the water too. Ports IB currently has 22 vessels deployed for coastal control and traffic management. Last year, 162 sanctioning proceedings were opened against illegal boat rentals, generating fines totalling more than €471,600. This year, 39 new proceedings have already been launched with around 70 more in the pipeline. Requests have also been sent to digital platforms to remove illegal listings for both accommodation and vessels.
The committee's work goes beyond tourism. The government has opened a permanent channel with local business organisations AFEDECO, PIMECO and the Balearic Confederation of Commerce to share intelligence on counterfeit goods and illegal street vending, with the aim of coordinating joint action against the unfair competition faced by small businesses. A new working group on land transport has also held its first meeting, continuing the existing commission's work against unlicensed operators in that sector.
It is a broad and coordinated effort, and for anyone playing by the rules in the Balearics, whether running a hotel, a boat hire business or a corner shop, the message is that the playing field is finally being levelled.
