Beware of using unqualified providers of UK wills and powers of attorney in Spain
Thy Will Be Done offers free initial consultations and meets every standard your legal provider should
For many expats in Spain, sorting out a UK will or power of attorney tends to get pushed to the bottom of the to-do list. When it does finally rise to the top, the temptation is to go with whoever is cheapest or most conveniently located.
According to Paul Blackmoore, Practice Principal at Thy Will Be Done, that approach can be a costly mistake.
The issue is that not everyone offering UK legal document services in Spain is properly qualified to do so, and the consequences of getting it wrong don't tend to become apparent until it's too late to fix them. By that point, the people left dealing with the fallout are usually your family.
There are five straightforward questions worth asking any provider before committing to their services.
- Does the firm have practitioners regulated by the SRA, the Solicitors Regulation Authority?
- Are the people actually drafting the documents qualified and registered with STEP, the Society of Tax and Estate Practitioners?
- Is the advice coming from someone trained and certified by the College of Will Writers?
- Does the company carry Professional Indemnity Insurance, so that your beneficiaries have legal recourse if something goes wrong?
- And does the provider have a UK office that your beneficiaries or attorneys can actually get in touch with when they need to?
If the answer to any of those is no, it's worth asking yourself whether you should really be using them at all.
Thy Will Be Done ticks every one of those boxes. The company holds Professional Indemnity Insurance covering up to £3 million per claim, operates from offices in Benijofar and maintains a UK office for the benefit of beneficiaries and attorneys back home. Their team combines UK-level professional standards with the kind of local knowledge and accessibility that expats actually need.
The good news is that finding out whether they're the right fit for you costs nothing. Thy Will Be Done offers free initial consultations either over the phone or face to face at their Benijofar office, whichever suits you best.
As Mr Blackmoore puts it, peace of mind for you and your family when it comes to matters like these far outweighs any initial cost considerations, and getting the wrong advice now could mean considerable time, money and stress for your loved ones further down the line.
