Important update from Camposol's Legal Platform against Biogas
Representatives meet with Councillor to discuss progress in legislation controlling biogas plant location

Camposol Legal Platform against Biogas representatives met with Mazarrón Town Hall’s Councillor for Camposol, Carmen Navarro to discuss the latest development in the process to define distance limits for the installation biogas plants in relation to populated areas. A proposal for such a plant around one kilometre from the Camposol urbanisation was lodged with the regional government in July of last year.
As reported in May of this year, after a technical report commissioned by the Camposol Platform on the proposed biogas plant and discussions between Mazarrón Councillor for town planning, Jesús García and representatives of the promoter company proposing to build the plant, the company was “reconsidering the initially planned location and evaluating more suitable alternative locations elsewhere”.
The Councillor for town planning also indicated that Mazarrón Council were in the process of drafting planning law amendments establishing a specific distance criteria for the implementation of this type of facility on land designated as undeveloped.
In pursuance to this the Council has commissioned environmental consulting specialists “Ideas Medioambientales SL” to formulate a Strategic environmental document, the document has been compiled and extends to 128 pages, laying out the minimum distances to be adopted for the installation of facilities including biogas plants on undeveloped land.
The document contains the following regarding biogas plants:
“Biogas plants are facilities or infrastructure for the production of energy obtained from agricultural activity, in which a waste management and treatment process is carried out. They must comply with applicable supra-municipal regulations, and specifically with the minimum distances to urban areas and population centres established in these Regulations.Due to their characteristics, they may only be located on Non-Urbanizable (undeveloped) land, in suitable environmental and isolation settings, complying with the minimum distances established below and with the environmental impact guarantees required by the corresponding environmental assessment declaration.
- 3,000 metres (3 Kilometres) from the urban area of the town of Mazarrón and Puerto de Mazarrón, as well as population centres originating from developed urbanizable land areas, such as existing residential developments (Camposol, Country Club, Rusticana, etc.), outlying districts, schools, health centres and medical clinics, as well as legal tourist establishments, regardless of their location within the municipality of Mazarrón, and those considered population centres.
- 500 metres from listed natural springs or sources.
- 100 metres. from ravines or watercourses included in the Inventory of Watercourses of the Region of Murcia with a Horton-Strahler classification of 3 or higher and within 100 meters of public watercourses under the jurisdiction of the Segura River Basin Authority.
- 2,500 metres from land designated for development. If the overall use is residential, a minimum of 3,000 metres must be respected.”
The document also covers other facilities including the location of new pig farms as well as planning laws regarding ramblas (dry river beds), watercourses and coastal areas.
The Councillor for Camposol explained that the new draft planning laws had been approved by Mazarrón Council’s governing board, Mazarrón Mayor, Council Secretary and municipal architect and the next step is the approval of the Council pleno and publication on the Regional Government website after which the draft stipulations become law.
While this may sound complicated and long-winded, changing laws is not something that can be actioned overnight and Mazarrón will be one of the first municipalities to adopt laws referring to the location of biogas plants in the Region of Murcia.
