ARCHIVED - Torrevieja council orders urbanisation to remove fence blocking access to the beach
Residents in Torrevieja, Alicante, have been prevented from reaching the Mal Paso cove by a fence blocking a public road
The Torrevieja local council have opened an urban infringement case which orders the removal of an illegally built fence and gate which block public access to the cala del Mal Paso.
The fence, in the Rocasblancas urbanisation, privatises a public street which falls under the jurisdiction of the Costas coastal authorities. There are also some stairs which provide access to the cove involved in the dispute. The Town Hall was first made aware of the problem in April, when a resident filed a complaint against the urbanisation.
The individual responsible for building the fence was then contacted and told to ‘legalise’ the structure by carrying out the necessary procedures, as is the usual protocol for these kinds of matters, but, in this particular case, there was no option to legalise the fence, as it blocks access to a public road owned by Costas.
Following this initial opening of the infringement case, the individual responded by saying that he had already presented a ‘responsible declaration’ (the simplest procedure which is required to carry out any minor building work), but failing to address the fact that this project requires a municipal license with a sectoral report from the Generalitat Valenciana and a municipal license with a report from the regional administration and the Costas area of the Ministry of Ecological Transition.
The Mayor of Torrevieja has since stated that the case will be communicated to the regional government in order to determine the next steps.
Cala del Mal Paso is located between cala del Moro (near Torre del Moro) and cala La Zorra and has become increasingly popular over the past few summers as it is one of the best conserved coves on the Torrevieja cove.
