For many expatriates living in Spain, purchasing property, securing residency or planning retirement are major milestones. However, one of the most important legal protections is often overlooked — having a Spanish Will.
Many expats believe that a Will drafted in their home country is enough. While it may still be legally valid, relying solely on a foreign Will can create delays, additional legal costs and unnecessary complications for loved ones when dealing with Spanish assets.
A Spanish Will helps simplify the inheritance process by clearly outlining your wishes and ensuring your estate can be administered more efficiently in Spain. It can also reduce the need for translated and apostilled foreign documents, helping families avoid lengthy administrative procedures during an already difficult time.
Another important consideration is that inheritance law in Spain differs from many common-law countries. Spain applies “forced heirship” rules, meaning certain family members may automatically be entitled to a portion of an estate. Under EU succession regulations, many foreign nationals residing in Spain may choose for the law of their nationality to apply instead — but this election should be properly documented in a Spanish Will.
Dying without a Will in Spain can create serious difficulties, including frozen bank accounts, delays in property transfers, increased legal expenses and potential family disputes.
Fortunately, preparing a Spanish Will is usually straightforward and affordable. It is one of the simplest and most effective ways to protect your family and ensure your wishes are respected.
At Elysium Wealth Advisors, in-house lawyers are able to assist expatriates with the preparation of Spanish Wills, helping ensure estates are structured correctly and in accordance with both Spanish law and the laws of their country of nationality where applicable.
Planning ahead today can provide valuable peace of mind for tomorrow.
